WASHINGTON — Rep. Dan Goldman BLASTS DHS Secretary Kristi Noem Over Abusive ICE Officer Reinstatement
WASHINGTON, D.C. — In a heated congressional hearing late last year, Representative Dan Goldman (D-NY), a Democrat whose district includes the federal immigration courthouse in Manhattan, sharply confronted Homeland Security Secretary Kristi Noem over an Immigration and Customs Enforcement (ICE) officer who was reinstated to duty only days after being placed on leave for alleged misconduct.
Goldman pressed Noem on why ICE officer Victor Mojica — caught on video forcefully shoving a woman inside the 26 Federal Plaza immigration courthouse in New York — was returned to active duty less than 72 hours after being suspended, before the internal watchdog completed its review.
“Why was this officer reinstated so quickly when the investigation was still ongoing?” Goldman asked during the hearing. Despite repeated demands, Noem’s office provided only a letter cutting to formal language about the process, calling the matter referred “for appropriate review” and asserting internal mechanisms and due process apply to personnel matters.
Goldman dismissed the department’s response as “wholly unsatisfactory,” saying it failed to explain what investigation or oversight took place between the incident and the officer’s reinstatement.
Video and Evidence Raised Alarm
Footage of the ICE officer forcibly pushing the woman prompted public outcry and rare initial administrative leave — a move that DHS then reversed with little explanation. The internal DHS Office of Inspector General later declined to pursue a criminal investigation into the conduct, deepening questions about accountability.
Broader Context: Oversight and Controversy at DHS
Goldman’s line of questioning was part of wider scrutiny of DHS and ICE practices, including expanded powers and controversial enforcement tactics under Noem’s leadership. Congressional Democrats are pushing for stronger oversight, citing systemic issues with transparency and accountability at the agency.
The episode also connects to larger national debates about ICE conduct following highly publicized incidents — including fatal shootings by federal immigration officers in Minneapolis — which have fueled protests and demands for reforms in use-of-force policies.
Noem’s Defense and DHS Position
Noem’s responses focused on procedural fairness and adherence to internal review processes, and her office has emphasized that personnel decisions reflect agency policy and due process. DHS has declined to provide detailed public explanations on individual disciplinary decisions.
